Glen Morgan commits an Act of Free Speech on a rainy day at the Washington State Capitol Campus

As I discussed a few days ago, we organized and planned the “Commit an Act of Free Speech” event at the Washington State Capitol Campus located in the City of Olympia last Saturday.  I wrote an article about this event (linked here), produced two videos announcing it (here and here), and I emailed all of this information to the state in advance, so they knew we were coming and what we planned at this event.  We had nothing to hide.

A video has been posted up about this event (linked here, and another one linked here), and I will post more video links as they are shared.  I could not take a good video of the event itself, so I will rely on the many people who brought cameras to document what they presumed would be my arrest.  Despite the rain (known as liquid sunshine in Washington State), a decent crowd of witnesses showed up to practice an Act of Free Assembly, an Act of Free Speech, The Right to Petition our Legislature for a Redress of Grievances, free press, and with prayers the right to practice religion (See 1st Amendment to Constitution, WA State Constitution Art1 sec 1, 4, and 5).  All the boxes were checked for a free speech event.

For doing this, with the speakers, microphone, cables, and generator – many people had been threatened with citation, fine, and arrest – until Saturday… (and yes, it was just as wet as it looked)

I was not arrested, which makes this a victory, but more importantly the Washington State Department of Enterprise Services, which manages the Capitol Campus), and the State Patrol, which is responsible for security, notified me on Friday the day before the event that they would suspend enforcement of the rules they had been referencing in the previous weeks when they threatened to cite and arrest others for committing free speech on the campus.  I did ask that an attorney from the Attorney General’s office be present in that conversation, but the AG avoided that scenario.  While some attorneys are disappointed at losing the opportunity to litigate against Washington State in Federal Court over such an egregious and unfathomable anti-free speech policy, it is still better that our civil rights not be infringed in the first place.  The right to free speech was restored, even if just in this small way on Saturday.  There will be many more fights like this in our future if we are to restore civil rights in this state.

Our rights, IF we exercise them…

It is always important to remember we only retain our rights and freedoms if we choose to exercise them.  For the past few weeks, the state had threatened citation and arrest to anyone who used speakers, microphones, chords, and mini-generators to power them on the Capitol Campus.  This was perplexing to most people because since the invention of electricity, this was a common and normal activity on the Capitol Campus, particularly during the legislative session, which starts the second week in January.  Yet, the excuse given by the State was that we could only do this with a permit and they were not issuing permits at this time.  Until Saturday, everyone capitulated under the State’s threats of citation, fines, and arrest.

I witnessed the effect of this effort to silence free speech on January 10th at an event where I spoke, in which we had to use marginal megaphones to be barely heard.  At the time, I just thought it was a one-off mistake by Covid-crazed bureaucrats distracted by Governor Inslee’s confusion over his own lockdown orders.  However, when Doug Basler showed me video from a few days later which demonstrated this had become the radical and absurd new policy at the capitol campus, I had all the proof that my attorneys needed.  We were eager to see if Washington State’s bureaucracy and the AG were willing to greenlight my arrest for committing an act of free speech.  This would be a bizarre action, even for the Inslee administration.  Fortunately for them, an adult obviously intervened and prevented any arrest from happening.

I have yet to identify the attorney at the State Attorney General’s office who signed off on this pathetic and exceptionally ignorant policy.  Once I can find her/him, I’d like to confront them and petition the State to send them to remedial law school or at least give them a test on basic civil rights and the constitution before they are allowed to come anywhere near practicing law again.  It could be that these attorneys have become so complacent and incompetent because they have been practicing law in the tame and corrupt Thurston County Superior Court where our constitutional rights and freedoms go to die as these judges are political creatures of the state.  Under Bob Ferguson’s leadership at the Washington State Attorney General’s office, it has become apparent that our civil liberties, the rule of law, and equal protection under the law have taken a distant and long forgotten second place to his political grandstanding and hyper politicized attacks on political enemies while creating legal cover for political campaign donors.

Obviously, if the State had arrested us, this case would have gone to Federal Court, which, unlike the Washington State Court system, still recognizes our civil liberties and constitutional rights.  While the state courts have become increasingly less tethered to common sense, reality, the rule of law, or the state constitution, it is important to remember there still are real courts with at least a few honest judges in America where we have at least a chance to protect our civil rights. Only in the Federal Court system, unfortunately.

The little victories on the path to freedom and liberty…

Saturday was a small victory for our freedom.  However, we will need to fight to get more victories like this, and it is clear if we plan ahead, work together, and stay united we can prevail.  I also want to thank Doug Basler for loaning me the sound system, knowing it might be seized.  I want to thank the anonymous friend who loaned me the generator which I couldn’t guarantee would ever be returned.  I want to thank the many attorneys who laughed so hard at the State’s egregious policy and who were so eager to represent me in such a case.  It would have been interesting to write letters from a Thurston County jail, but that will have to wait for another time.

For now, always remember, the future does belong to those who show up.

Every few generations we have to stand up for free speech. This era is no different.

    • Tim was defined as a human PAC. Fined $2.6 million. Plus whatever fake legal costs the AG makes up. The weirdest set of political free speech restrictions ever imposed on an activist in state history. Typical stuff for Thurston County Superior Court…

      • Im horrified and furious about the decision in T E. case that is a blatant and perverse VIOLATION of both law and his rights and property and yes what we can expect from that court and all the courts at least west of the CASCADES. As I saw you very emotionally comment a while back in event at Yelm THEY DO NOT CARE SO NEITHER SHOULD WE ABOUT THEM , THEIR LAWS OR THEIR WICKED MINDS .   1. I’m so thankful that 01 was arrested & nothing was confiscated. I was concerned that Antifa or BLM or sum1 was going 2 make a scene. Instead, I was able 2 watch the whole thing w/o getting wet from my cozy home on a hill in n. central WA & rejoice w/ u all. I’d really prayed & asked others 2 do so. Thank God!

  2. Good job, I salute you. Now you are REALLY on the fecal roster with the powers that be in Olympia. Better make sure you are not being followed, wiretapped, or your mail tampered with. You should also switch your mailing address to a post office box. Those in charge have zero scruples and will do anything to present you in a negative light to the media (who will gleefully comply).

  3. Congratulations! Thank you for standing up. I shared the event in several groups for WA on MeWe and just shared this article. I left Fakebook, partly for sanity and due to my son in law being concerned about me being a target, lol.

    • Facebook’s suspension/censorship effort of me has been lifted (temporarily I’m sure), but I’ll keep using it until they shut me down. Thanks for sharing about the event. The main thing is to share that the State was forced to abandon their efforts to silence free speech on the Capitol Campus…

BUT THE SITUATION HAS GONE FAR BEYOND THAT , AND I THINK THEY WILL WILL ONLY ALLOW LITTLE VICTORIES THAT THEY BELIVE DONT MATTER , BECAUSE ITS NO REAL THREAT TO THEIR POWER , POSITION OR SAFETY .     • Yep, while I’m not going to stop pushing back and exposing the truth. As for Eyman’s court case, it is a bit late for that. You would have needed to be involved about a year ago or so…
